TERMS AND CONDITIONS NATIVA GEMS
Please read Nativa Gems Imp. & Exp. de PedrasEireliTerms and conditions, as you make an agreement with the terms that govern Nativa Gems services and purchase orders as described below:
1.1 ORDER QUANTITIES AND M.O.Q. (MINIMUM ORDER QUANTITY)
1.1.1WHOLESALE ORDERS
Products sold by Nativa Gems to wholesalers have exclusive wholesale prices only if the client reaches the company’s M.O.Q.purchase of USD$500 on items in stock and USD$750 on items to be produced.
1.1.2RETAIL ORDERS
Products in stock are available for retail purchase with an increase of 50% on orders from USD$100 to USD$249 and 30% on orders from USD$250 to USD$499 over the wholesale catalog main price.
1.2 PURCHASE
1.2.1 PURCHASE ORDER
Purchase orders are made by registered users. Once a purchase order is requested, it’s directed to the client’s sales representative who will analyze the order and contact the client through e-mail or phone for final adjustments. An official Purchase Order (PO) will be sent to the client and the payment procedure can start.
1.2.2 PAYMENT OPTIONS
Nativa Gems appreciate discretion in all transitions and secures safety on all monetary transitions made along with Nativa Gems Imp. & Exp. de PedrasEireli. Throughout payment and conversations between both parties, it’s agreed and explicit that both parties verified each other’s authenticity. Nativa Gems guarantee security in their conversations and it’s not responsible for any possible scams, identity forgery, or malicious content, such as phishing, from third parties due client’s lack of attention.Nativa Gems is not responsible for any payment made to third parties. We are completely available to our customers and will use all means to show our authenticity and advise clients to have caution and request proof of our authenticity in case of suspicious behaviors. Nativa Gems takes full responsibility for any incident that might happen due to intern issues and partial responsibility for any incident that might happen due to issues caused by Nativa and the client together. Nativa is not responsible for any incident caused by third parts.
Please do not accept or pay any payment request without our formal invoice or a PO (the purchase order form) sent directly from our sales representatives ONLY from our domain “@nativagems.com”, followed by one of the following: a PayPal request from Nativa Gems ONLY; Proforma Invoice for bank transfer on the account by the name Nativa Gems Importacao e ExportacaoONLY; or a credit card form with our company’s information and sent ONLY by our domain“@nativagems.com”.
Nativa Gems is completely responsible for keeping the privacy and protection of its client’s bank account and card information, and will not use for any means except for the specific purchase order authorized by the client.
1.2.2.1 PAYPAL
A PayPal payment request will be made to the client’s PayPal account. PayPal charges 8% of the total per transaction. On wholesale order that amount will be shared between both parts, leaving a 4% charge to the client and a 4% charge to Nativa Gems. On orders below USD$750, the client will be charged the full 8%.
1.2.2.2 BANK TRANFERs
Bank transfers will be accepted once sales representative makes a formal Proforma Invoice, which will contain all specifications needed and all settlements made for the payment. Proforma invoices will come with shipping costs included, to avoid unnecessary extra charges to both parts, except for specific requests.
Nativa Gems accepts money transfers from all banks, under those fees:
Wire transfers equal or less than USD$749 = USD$100;
Wire transfers from USD$750 to USD$1499 = USD$50;
Wire transfers equal or more than USD$1500 = free of fees.
1.2.2.3 CREDIT CARD
Master and Visa credit card flags are accepted for purchase orders. Nativa Gems is entirely responsible for holding the client’s card information and will ask client to sign an authorization form that has to be signed and sent to our sales representative for each purchase.NativaGems will take care of credit card taxes, except for a 0.5% tax pre-established by Cielocompany for international purchase and coin conversion. Also any other taxes that the client’s bank might apply. Please note that for security reasons some banks might ask a direct call or clearance of the amount from the client for transition to be complete.
1.3 SHIPPING COST
Smaller orders are usually shipped by air. Larger order are usually shipped by sea. Delivery can be made door-to-door, airport, or pick up at a courier station. Clients can choose to have their own courier shipping the order. Shipping costs and import fees are paid by the consignee, except by singular occasions, and they will be charged after the order is ready to ship, except when the client paid in advance.
Check with sales representative quotations for shipping costs.
2.1 PRODUCT UNITS, WEIGHTS, AND ADD-ONS
Each Nativa Gems product category has its price and quantity measured and valued by one or more of those specific attributes: pieces, kilos (around 2.2 pounds), lots, or boxes. Along with those standard measurement units, products can have add-ons and will be charged for those. The most common add-ons are platting (gold or silver), drilling (1, 2, or 3 mm holes), and extra pins. Add-ons are subject to charge if not already part of the product as described in the Nativa Gems product catalog. Any other specifications should be dealt with directly with the client’s sales representative.
2.2 PRODUCTS CATEGORIES AND PRICE RANGE
2.2.1JEWLERY
Jewelry orders above USD$1000 have free shipping. All plated jewelry can come in gold or silver. All pendants are also available with two connectors (add USD$0.25 per piece).
Jewelry prices might change if it is handpicked or a sub-selection is made. Subject to sales representative verification. Jewelry prices can be found and valid through the latest version of Nativa Gems Jewelry catalog.
2.2.2 HOME DECOR AND MINERALS
Nativa Gems Home Decor products have a price range based on one or more specifications: Quality, number of units ordered, size, add-ons, handpicking, per lot, and to select.
Qualities (top to bottom): Especial, Super extra, extra, A or 1, B or 2, C or 3, and so on;
Prices under the section ‘per lot’ means the client is ordering a random product from that lot, while prices under the section ‘to select’ mean the client is selecting a specific variation from that lot. Also handpicking or choosing a specific piece(s) might alter the price. Subject to sales representative verification;
Each product in this category will have its specific pricing that can be found and valid through the latest version of Nativa Gems Home Decor and Minerals catalog.
2.2.3 ROUGH
2.2.3.1 FOR INDUSTRY
Nativa Gems rough for industry comprehends a great variety of rough stones for industry uses. This section of products is available upon request and to be dealt directly with the sales representatives only. The price range will vary based on stone type and amount purchased on the following scale: up to 1 ton; 1 to 10-ton and 10-ton plus.
3.1 STOCK PRODUCTS
Stock products are all products that have already been produced or extracted and are physically in our warehouse.
3.2 PRODUCTION PRODUCTS
Production products are products that we can put to production once we have an order paid for the production of those items. Most of our orders are made by request and need to be paid in order to be produced.
3.3 PACKING AND SHIPPING
All products are carefully packed into plastic sheets, bubble wrap, and Styrofoam and then put in a carton box. Orders are picked up by courier in our warehouse. Some products require special packaging and for those cases, a sales representative will instruct and explain which procedures are necessary (for example pallets or containers).Nativa gems is responsible for all the order until it leaves the warehouse. Nativa gems compromise to choose the best way to ship and is in constant contact to its courier to make sure products are delivered in perfect conditions. Nativa Gems is not responsible for any damage that might be caused by its courier or after products are delivered. Particular cases can be dealt directly with sales representatives.
If you receive a damaged, violated, or in bad condition package or merchandise, please take pictures before opening it, make sure to check with Nativa Gems sticker is intact, and send those to us, explaining the situation so we can take the proper measures towards our courier.
4.1 STOCK ORDERS
All stock orders leave the warehouse from 1 day up to 2 weeks (depending on paperwork, payments, holidays, packing process, and season). For transit time is necessary to talk directly to a representative to check the location and timeframe from the courier.
4.2 PRODUCTIONS ORDERS
All production orders leave the warehouse within 3 to 6 weeks on average. Nativa Gems inform that this timeframe can suffer alterations or delays for some products based on a couple of facts, such as large orders of hot products; unique quality products; products in the colors black, red, and teal; or any other order with requirements that demands extra time to be manufactured, mined or selected. It’s always advised to check with representatives the status of certain items since our products are natural stones and go through various steps (some even depend on the weather) from mining, classifying, manufacturing, and quality control by our team, to finally be available to our customers.
Nativa Gems representative is responsible to give customers the most approximate lead time on those cases and keep them updated on the order process. In case that timeframe has not met the company won’t grant free shipping, free products, or any other perks, except specific negotiations with the sales supervisor.
For delayed orders there are those options, in the following order:
4.2.1 BACK ORDER
Products that can be delivered on time can stay on back order, waiting for those specific items to arrive so they can be shipped. It’s the customer choice to wait for the whole order to be shipped or to have items ready shipped first;
4.2.2 REPLACE OTHER PRODUCT
In cases when customer can’t wait for the merchandise to be found, made, or arrive that merchandise can be exchanged for other products of the customer preference that match the amount already paid;
4.2.3 STORE CREDIT
In case the customer doesn’t want any of our products in stock, the amount of the merchandise in question can be left as store credit for the next purchase or, for when one item of customer’s interest arrives, it can be replaced, matching the price or having its difference as a store credit;
4.2.3 REFUND
In extreme cases, a refund can be requested. Once a customer opens a refund request with a sales representative it takes a period of 7 to 14 work days to be analyzed to be approved.The financial department will need all documentation to approve the refund. Documentation valid is the history of e-mails exchanged with customer, pictures of products, explanation letter for the reason of the refund and so on. Refunds of large amounts might take longer and Nativa Gems reserves the right to define datelines to credit the refund back upon the guarantee of a full refund once it’s approved. Refunds are only accepted after six weeks of delay or a specific due date for exception products.
5.1 IMAGES AND VIDEOS
All images and videos sent to our clients can only be shared with credit to Nativa Gems and can’t be published for defamation or to make a bad reputation for the company.
5.2 EXCLUSIVITY
Nativa gems reserve the right to not work with exclusivity of products to any company and not to engage with distributors or related business to represent or carry Nativa Gem’s name and products.
Nativa Gems is Located in South Brazil, therefore we are 100% available from 8:30 to 18:30 from Monday to Friday on GMT/UTC – 03:00 hours.
